ERRC v Greece, Collective Complaint 15/2003 (discrimination, housing)

The European Roma Rights Centre filed a collective complaint against Greece, under the Revised European Social Charter. The ERRC asked the Committee to hold that Greece was failing to respect Article 16 of the Charter, taking into account that Roma did not effectively enjoy their right to housing, that national legislation discriminated against the Roma in housing matters, and that Roma were often subject to forced evictions.
The Committee held that the insufficiency of permanent dwellings constituted a violation of Article 16 of the European Social Charter. It also held that the lack of temporary stopping facilities constituted a violation of Article 16 of the European Social Charter. Finally, it held that the forced eviction and other sanctions against Roma constituted a violation of Article 16 of the European Social Charter.
